Custer County Felony Filings
Criminal District Court filings are largely composed of felonies and misdemeanors that are part of felony cases. Felonies are serious crimes like robbery or elder abuse. Prosecution of these crimes doesn’t just seek to punish, but is a deterrent and pathway to treatment or reform for some offenders.
In 2025 the Miles City Police Department reported 145 felony cases for the year. In the Custer County district court, 35 cases were filed. Since then, half-way into 2026, just 12 cases have been filed.
Since the start of the current County Attorneys’ assignment and then election, there has been a roughly 81% drop in filings. Charging for drug possession and distribution fell off in late 2024 and the last charge for possession was filed in February 2025.
Drug offenses have not disappeared, and methamphetamine offenses have remained stable in the rest of the state over the last five years where they are still being charged. Not charging serious crimes doesn’t make them go away, it just removes the deterrent against doing them.
Prosecution of child sex crimes stopped in 2024.
